Effective August 18, 2026
Online Auction Terms
By placing a bid, each bidder agrees to these terms and confirms that the information submitted is accurate.
1. Auction schedule
The auction opens Tuesday, August 18, 2026 at 5:00 PM Mountain Time and is scheduled to close Tuesday, September 1, 2026 at 5:00 PM Mountain Time. A valid bid received during the final five minutes extends the current closing time by five minutes. Additional qualifying bids can cause additional extensions. The auction server timestamp is the official time.
2. Item offered
The package includes two tickets to one Denver Nuggets or Colorado Avalanche home game, private seating in Suite #1 at Ball Arena, and one parking pass. The winning bidder chooses one of the two teams. The game date must be mutually agreed upon with the donor, is subject to availability, and must occur on or before January 31, 2027. Exact seat, access, delivery, and event details will be provided during winner coordination.
3. Value, opening bid, and increments
The good-faith fair market value is $700. The minimum opening bid is $700. Each later bid must meet the minimum amount shown by the auction system and follow the $25 increment. Bids are stated and payable in U.S. dollars.
4. Bidder eligibility and binding bids
Bidders must be at least 18 years old and legally able to enter a binding agreement. A submitted bid cannot be withdrawn merely because the bidder changes their mind. Fremont Community Foundation may contact a bidder to verify identity, contact information, or intent before recognizing a bid as valid.
5. Valid bids and technical issues
FCF may reject, disqualify, or correct bids affected by suspected fraud, inaccurate contact information, unauthorized automated activity, obvious typographical error, system abuse, or a material technical malfunction. Courtesy confirmation and outbid notices are not guaranteed. Each bidder is responsible for monitoring the auction page and submitting bids before the official closing time.
6. Winner and payment
The highest qualified valid bid at closing is the winning bid. If equal bid amounts are ever accepted because of a technical condition, the earliest valid server-recorded bid controls. The winner will be contacted using the submitted email address or phone number and must complete payment within 24 hours through the secure payment method provided by FCF. Credit-card information is not collected by the auction bid form.
If the apparent winner cannot be verified, declines, or does not pay on time, FCF may disqualify that bid and offer the package to the next-highest qualified bidder. FCF may also pursue other remedies available for a binding bid.
7. Ticket fulfillment and event changes
Tickets and the parking pass will be delivered or transferred after payment and scheduling coordination. The package is subject to the ticket issuer's and venue's rules. If a selected event is postponed or canceled, the parties will work in good faith to identify an eligible replacement date, subject to donor availability and the January 31, 2027 deadline. FCF cannot control team schedules, venue policies, weather, event cancellation, or third-party ticket systems.
8. Refunds and transfer
All sales are final after payment, except when FCF determines that it cannot provide the described package. The winner may not resell the package for commercial purposes without written permission. Any transfer request is subject to approval, verification, and applicable ticket rules.
9. Tax information
FCF publishes a good-faith fair market value of $700. If FCF is a qualified charitable organization and the winner pays more than that value with the required charitable intent, the amount above fair market value may be eligible for charitable-contribution treatment. Tax consequences depend on individual circumstances; bidders should consult their own tax adviser. FCF does not provide tax advice.
10. Privacy and communications
Bidder information is handled as described in the auction privacy notice. By bidding, the bidder authorizes transactional email and telephone contact concerning bids, auction status, verification, payment, and fulfillment. This does not constitute consent to unrelated marketing.
11. Administration
Fremont Community Foundation may pause, extend, reschedule, or cancel the auction when reasonably necessary to protect fairness, security, or the availability of the package. Decisions made in good faith by FCF regarding bid validity and administration are final to the extent permitted by law.
